Members can be held legally liable for the content they post and may be held legally accountable if their postings include defamatory comments or material protected by copyright, trademark, patent or trade secret law without the permission of the author or owner.
- The user agrees to indemnify and hold harmless www.SendwithMe.com, its employees, directors, officers, agents and their successors against any and all liabilities, injuries, damages, losses, costs and expenses, including attorney's fees, caused by or arising from or in connection with the content of the user's postings including any claim of defamation or dishonesty, any package exchange delegated between two users on www.SendwithMe.com, any violation of rights of privacy or publicity, loss of service by other members and infringement of intellectual property or other rights.

- www.SendwithMe.com reserves the right to release current or past member information that www.SendwithMe.com believes is in violation of the terms of service or page content guidelines, or used to commit unlawful acts, or if the information is subpoenaed, and/or if www.SendwithMe.com deems it necessary and/or appropriate.
- www.SendwithMe.com provides this service with the best possible intentions and is not liable for any unforeseen event such as interruptions, failures, delays in the delivery of content or services available within the Membership area.
- If any part, term, or provision of this Agreement shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any law of central, state, or local government having jurisdiction over this Agreement, the remaining portions or provisions shall still remain valid and continue in full force and effect.
- This Agreement shall be governed and construed in accordance with the laws of the State of Maryland, without resorting to any jurisdiction's conflict of laws, rules or doctrines. Any claim, action, suit, or proceeding (collectively, "Claim") between www.SendwithMe.com and the User that arises from or relates to this Agreement shall be brought and conducted solely and exclusively with a Court of competent jurisdiction in Maryland.
- www.SendwithMe.com reserves the right to take any or all action it may deem appropriate, in its sole discretion, with respect to violations or enforcement of the terms of this Agreement, and expressly reserves all rights and remedies available to www.SendwithMe.com at law or in equity.
- www.SendwithMe.com expressly disclaims all guaranties of any kind, whether express or implied.
www.SendwithMe.com makes no guarantee that the services will meet the member's requirements, or the services will be uninterrupted, timely, secure, or error free; nor does www.SendwithMe.com make any guarantee as to the results that may be obtained through the service or that defects in the software will be corrected.
- www.SendwithMe.com does not endorse in anyway any content, views or comments made by members on their Posts. Please therefore verify the authenticity of all information before undertaking reliance and action thereupon.
- www.SendwithMe.com will not be responsible or liable for any consequential damages arising on account of the member relying on the content.
www.SendwithMe.com will not be liable for any indirect, incidental, special or consequential damages or for miscommunications, lost property or lost profits arising out of or in connection with this service, even if www.SendwithMe.com has been advised of the possibility of damages.
- Users under the age of 16 are not allowed to establish and/or maintain accounts on www.SendwithMe.com.
